The Bermuda Agreement (a formal agreement between the United Kingdom government and the United States government on air services between their respective territories), concluded in 1946 by U.S. and British negotiators in Bermuda, was an early bilateral agreement on air services. It has set a precedent for the signing of about 3,000 other such agreements between countries. The agreement was replaced by the Bermuda II Agreement, signed in 1977 and entered into force in 1978. (b) Subject to the provisions of paragraph (e) in this paragraph, no party takes unilateral action to prevent the introduction, continuation or termination of a fare, price or fare charged by an airline designated by a contracting party. Where a party believes that a proposed or proposed tariff or rate for other airlines is contrary to the agenda, discriminates between shippers in similar circumstances, or is too high or restrictive in a manner that constitutes an abuse of a dominant position, it may inform the other party of the reasons for its dissatisfaction and seek consultation. On request, these consultations begin no later than thirty days after receiving the application. If such consultations are agreed upon on a reasonable tariff, price or rate, each party strives to do everything in its power to bring the agreement into force. In the absence of an agreement, the rate, price or rate initially proposed or charged will come into effect or will continue to apply. The inclusion of many fifth freedom routes (beyond the United States and the British Isles) reflected the fact that many regions, such as Hong Kong, Singapore and India, were still British colonies at the time of the signing of the agreement and that many third countries were eagerly awaiting air services and were prepared to grant unlimited rights to British and American airlines. [deleted in accordance with the 04/07/97 agreement with Hong Kong] (1) Do UK nationals hold less than 50% interest in an airline; Registered in another Member State of the European Community and with its principal headquarters, the United States Government cannot object to the right of that airline to provide air services under the bilateral agreement between the United States and that other Member State solely on the basis of that participation of the United Kingdom or on the basis of the ownership of the United Kingdom. b) The United States Civil Aeronautics Board has announced its intention to approve the International Air Transport Association`s rate conference machine (`I.A.T.A`), as presented in February 1946, and will be subject to board approval of all tariff agreements with these aircraft during that period and in which U.S.
airlines participate.
